Individual Freedom vs Collective Freedom

Is it ever okay to remove the freedom of an individual in the name of group freedom?

That is a question facing all Canadians and for that matter individuals around the world as governments everywhere seem to be rushing toward total nanny state administrations.

The implementation of the Emergencies Act using section 1 of the Charter is totally unjustified. What is happening in Ottawa and other parts of the country is not insurrection. We are not at war. We see ordinary had working Canadians who are fed up with over two years of draconian totalitarian type rule by their governments. Canadians who no longer are sitting back and saying well maybe it will get better. Folks if allowed to continue it will continue. Once we waive our basic rights as defined in the Charter of Rights and Freedoms and defer our well-being to elected and unelected governments our freedoms are lost.

No government has the right to determine one’s God-given basic rights. God gave us freedom of choice not government and only God can take that away.

Before everyone attacks the Freedom Convoy stop and think…

Prime Minister under fire for comments

The Prime Minister accused Conservatives of supporting Nazi swastika while replying to a Jewish Conservative member. He refused to apologize for this significant insult.

The Charter of Rights and Freedoms is Sacrosanct

If you haven’t listened to Brian Peckford then it is a must. He was involved in crafting the Canadian Charter of Rights and Freedoms and knows of what he speaks.

Canadian Charter of Rights and Freedoms

THE CONSTITUTION ACTS, 1867 to 1982 (justice.gc.ca)

Conclusion

Collective rights do not trump individual rights in a free and democratic society under any circumstances. What our governments have and are doing to us is not free and democratic. When governments in a free and democratic society impose ongoing autocratic and totalitarian authority on their people they are moving that society into a totalitarian state.

The Freedom Convoy even though annoying to many, disruptive to some, economically damaging to others stands for the rights as defined in the Charter of Rights and Freedoms as pointed out by Brian Peckford.

“Fundamental Freedoms

2 Everyone has the following fundamental freedoms:

  • (a) freedom of conscience and religion;
  • (b) freedom of thought, belief, opinion and expression, including freedom of the press and other media of communication;
  • (c) freedom of peaceful assembly; and
  • (d) freedom of association.

Mobility of citizens

  • 6 (1) Every citizen of Canada has the right to enter, remain in and leave Canada.
  • Marginal note:Rights to move and gain livelihood(2) Every citizen of Canada and every person who has the status of a permanent resident of Canada has the right
    • (a) to move to and take up residence in any province; and
    • (b) to pursue the gaining of a livelihood in any province.
  • Marginal note:Limitation(3) The rights specified in subsection (2) are subject to
    • (a) any laws or practices of general application in force in a province other than those that discriminate among persons primarily on the basis of province of present or previous residence; and
    • (b) any laws providing for reasonable residency requirements as a qualification for the receipt of publicly provided social services.

Legal Rights

Marginal note: Life, liberty and security of person

7 Everyone has the right to life, liberty and security of the person and the right not to be deprived thereof except in accordance with the principles of fundamental justice.

Marginal note: Search or seizure

8 Everyone has the right to be secure against unreasonable search or seizure.

Marginal note: Detention or imprisonment

9 Everyone has the right not to be arbitrarily detained or imprisoned.”

The so-called weeny clause can only be used by government to override any and all freedoms defined in the charter in the time of war and insurrection neither of which applies with the Freedom Convoy.

1 The Canadian Charter of Rights and Freedoms guarantees the rights and freedoms set out in it subject only to such reasonable limits prescribed by law as can be demonstrably justified in a free and democratic society.”
