Canadians Travelling to the USA

Vaccinated Canadians travelling to the United States for more than 72 hours are required to have a negative PCR test before they are allowed back into their own country. Is this even legal? How can the Canadian government prevent a fully vaccinated Canadian citizen from returning to their own country?

Charter of Rights and Freedoms

The Charter of Rights and Freedoms protects all Canadians from being put in potential danger.

“Protection against unreasonable laws

The Charter protects everyone against unreasonable laws that could lead to imprisonment or harm their physical safety. The law may still comply with the Charter if it is consistent with a basic set of values. For example, there must be a rational link between the law’s purpose and its effect on people’s liberty. Also, laws should not have a severe impact on people’s rights to life, liberty or security of the person.”

The Issue

For a vaccinated Canadian to visit the United States for a period longer than 72 hours and have Covid-19 insurance for instance it will only be granted on a per visit basis and only for a specified length. If one stays beyond that date the insurance is no longer in effect. If for some reason the person tests positive in the required PCR test within 72 hours of returning to Canada the way the government puts it they will be refused entry.

I believe this is a violation of the Charter section above since without any insurance coverage and the potential of getting sick with Covid-19 in the United States the person has been put in to a situation of potential physical harm. Does that not then mean such actions by the government violate the section of the Charter mentioned above by imposing such a policy?

Every Canadian regardless of their health situation has the right to expect to be able to return to their country where they have access to appropriate healthcare.

I’m, not even sure this policy is actually a law but rather an edict by the government in power.

Conclusion

Finally, it is time every Canadian citizen stood up against the tyranny of this government and insists that such an edict be immediately abandoned as it relates to all Canadian citizens returning to this country from the United States. No PCR test requirements for any Canadians should be the basis for them returning home whether sick or healthy, positive or negative…period.

If the government of Canada wants to ensure Canadians are not positive then at a cost to the government they should perform a PCR test in Canada upon a Canadian’s return.
